This is a legal agreement between All Time Favorites Inc. (ATF, We, Our) and Supplier/Merchant/Member/Vendor/Client (You, Your).

These terms apply to products and services such as advertising in our directories, being contracted by All Time Favorites, and receiving customer leads from All Time Favorites Inc. from our websites and communications systems. "You, Your" also includes informing your staff, employees, and those under your direction about these terms.

Important: To make sure you do not miss any emails from us, add us to your contact list and "safe list" so that emails from any address at alltimefavorites.com come to your inbox and do not get filtered to junk/spam/updates. Contact your email provider on how to filter all email from us to your inbox.

General Conditions

These Terms and Conditions of Use (the "Terms") apply to your advertising on, access to, and use of www.alltimefavorites.com ("ATF," "Site," "we," "us," "our"). You ("Member," "User," "you," "your," "advertiser," "member," "vendor") agree to be bound by these terms in full by signing up and participating in our products, subscriptions, and services.

We offer products and services to You as "Products," "Subscriptions," or "Services" listed in this contract. If these terms are not acceptable, then do not submit your information to our Site or use our Site(s).

Code of Conduct

Good moral character, ethics, honesty, and high integrity are very important to All Time Favorites. To be a part of All Time Favorites, members/vendors agree to operate your business in an ethical, law-abiding, respectful, and honest way. Our goal includes respecting all people regardless of race, religion, nationality, sexual orientation, gender, or age.

We are not telling you how to run your business. We are telling you how we run our business and what the standards are to be a member here. This comes from our 30+ years of experience, over 50,000 vendors/members, and over 450,000 clients.

Many of our large clients require a detailed Code of Ethics or Conduct signed by our members to work on large corporate and public events to help protect their image and brand (and ours).

Your account can be suspended or closed (without refund) if you, your staff, or subcontractors are knowingly doing business with companies, people, or organizations where it is widely known or you are aware that they have engaged in the following:

  • Illegal activities (including but not limited to): being convicted of verbal, physical, or sexual attacks on others;
  • Distribution/promotion of: conspiracy theories, disinformation, proven false information, or fake news;
  • Bullying, cheating, or disrespecting others;
  • Promoting known lies;
  • Promoting white supremacism, racism, anti-semitism, homophobia, or any type of hate speech;
  • Promoting the war against Ukraine.

We monitor social media posts and other communications to assure our Code of Conduct is adhered to.

Advertising and Marketing Leads Plans

If you are participating in our leads service or directory listing/advertising/marketing services, here are the terms related to those services.

We screen vendors applying to be a member here. We read online social media posts, reviews on other websites, and use other ways to filter out low-quality vendors and those who do not fit our code of conduct and business model. It is completely up to our sole discretion to allow a vendor to register with us and is also up to our discretion to close any account that does not meet our standards.

Legal Note on Call Routing / Forwarding / Recording

We do track calls, emails, and texts to your company. Some calls are recorded (without further notice) to help track referrals to you. This requires you to promptly log in to your account to read and listen to communications from clients, or you can lose your listings or subscription.

We may put up our call routing or referral phone numbers and extensions in place of your phone number in order to track referrals and quality of service. You agree to:

  • Allow automated calling systems and text communications to alert you of client communications, missed or late responses to client communications, and account-related messages.
  • Alert your staff receiving calls on phone numbers from ATF that these may be recorded without any further notice.
  • Abide by all local, state, and federal call recording laws and regulations.

Plan Options

Basic Plan - Website Listings and Leads

Basic Listing - Within Your Trial Time-Frame

  • No up-front monthly cost for your business listings.
  • Profile page on our website listing your product/service categories/cities across our websites.
  • Profile pages and listings are limited to space available and under 50 listings in general.
  • 10% commission is due on all sales from us within 30 days after the event date or when your client received your products/services.
  • You pick the products, services, and cities that you serve and we will list those on our websites.
  • We refer clients to you in many ways: email, phone, your online profile, email message, or text messages.
  • Free call routing of calls using our phone numbers or extensions to your phone number to document value from us.

Basic Listing - After Your Trial Time-Frame

The system will tell you when your trial is over. Most times 30–90 days after your trial listing begins (or after 10 leads received), the following takes place:

  • 10% commission is still due on all clients referred to you that resulted in a current or future sale while on the trial plan.
  • If you choose NOT to pay anything additional per month and stay on the Basic Listing, we may remove your phone number from your profile and have clients contact you only through our messaging system.
  • We may also not display listings unless we have space available.
  • Not many leads may come your way after your trial time-frame is over.

Commission Questions?

A 10% commission is required back to All Time Favorites within 30 days after an event is completed or delivery of products/services to your client, based on the gross sales price of clients referred to you from All Time Favorites.

Example: A $500 rental agreement = 10% = $50.00 commission back to All Time Favorites.

Please track leads from us closely as there are strong penalties for failing to pay timely commissions.

Standard Advertising Plans - Website Listings and Leads

Benefits of paid subscriptions:

  • Higher listings on our web pages.
  • Priority over Basic Plan (non-paying) vendors when working under All Time Favorites on large events.
  • Faster referral of leads to you.
  • More traffic to your company profile than Basic Listing Vendors.

Options within this plan: (login to your account to see prices and all options)

Rates are based on the categories and cities you pick in your member account.

A. Minimum Standard Rate Plan:

Pay a minimum monthly fee + 10% commission (on the gross sale price) to keep listings and get leads. If you pay less than the minimum required, our computer will auto-pick the categories you are in for listings and leads (based on your website).

B. Premium Plan:

Continue to get leads and listings for the categories you have on file. Link to your website directly from your profile page on our website. Optional 10% commission on sales from referrals - except for a single client during a calendar month ordering over $2,500, in which case 10% is due only on the amount over $2,500 (not the amount under $2,500).

Why should you pay optional commissions? It gives you bonus points in your account for higher listings in our directories and many other benefits.

Position on our web pages is based on many factors including speed of response to clients, quality of products and services, feedback from clients and your peers, reviews, amount paid per month, and commissions paid accurately and on-time.

Nonprofit Plan - Website Listings and Leads

For registered 501(c)(3) and similar nonprofits only.

  • No monthly fee for basic listings.
  • Leads and listings if space is available on our websites.
  • Commission to us on sales is optional, but appreciated.
  • We do require you to put us on your referral list (if you have one).
  • Usage fees apply if volume of leads and traffic increases beyond a certain level.
  • The number of items listed (category + city) may change in the future but is FREE for under 100 categories at this time.

Custom Plan

We can do a custom plan from % of revenue share, pay-per-click, and many other options to list you on the top of our pages, exclusive listings, and more. Call 800-232-6874 ext. 388 for Brian for a custom package.

Subcontractor Plan - Sub-Contracted Only

No cost to be on this plan at this time. No website links or profile listing on our website with your company information.

Under this plan, we use materials from the Internet, your website, and/or what you send us and create materials without your name and contact information on them (as you wish to be subcontracted only). We may use these materials, edit them, and use them in our marketing and advertising and on our websites in perpetuity. The goal is to attract customers and get you work.

ATF will send you leads to quote and you will quote pricing back to ATF. ATF will pitch to the client, add our margin to the price, and contract you on the job if the client accepts. There is no monthly account fee on this plan.

All Plans - General Terms

Keep in mind that we screen leads for large corporate clients and have been in the events business for over 30 years. Some clients and larger client events, we may become the primary event production company for that lead. We also have many years with a large client base prior to our Internet Leads System, so some clients remain ours.

We do not guarantee that every lead received is available directly - some leads will be subcontracted under All Time Favorites or one of our networked production companies. We can win many of these competitions for event production over other companies and then subcontract our vendors on those events. These are complex events with many moving parts from logistics, insurance, OSHA, security clearances, background checks, technical production, celebrity act negotiation, and more.

Under any advertising and marketing plan, we can use images, media, audio, videos, links, and other promotional advertising materials that you have given us access to online or delivered electronically or via mail to ATF. We can create materials from and edit these for our websites and for marketing your products and services in any forum with or without your contact information on them in perpetuity.

AI NOTICE: We may use AI to edit and generate content from your materials (listed above) for promotional content on our websites and to promote your products and services. We do not break down your voice or original songs to create new content from the voice or original music without your explicit permission.

For all paid advertising plans, there is a minimum cost of $10.00 per month required.

If you are on a commission plan, the current commission rate on sales is 10% back to All Time Favorites computed on the gross price within your agreement with the client (minus any airline fees, hotel fees, or transportation/shipping costs). You can contact ATF about a specific client and negotiate outside that amount, but ATF and Vendor need to both agree on a variance for that purchase or event.

Points and Promotional Credits

You can earn reward points and/or promotional credits for simply linking to our website pages, writing articles about us online, referring clients to us, responding to leads quickly, and other ways. These points may include promotional credits that you can apply to qualifying products and services offered here. These can apply to your monthly account maintenance fee for paid advertising accounts or used on any product or service we offer.

Additional General Terms

Section 1. Usage Fees

FOR ALL ADVERTISING ACCOUNTS AND PLANS - all accounts may trigger a usage fee at some point if the volume of traffic, emails, and leads to you exceeds regular usage levels. You can approve any new fees prior to their charging.

ATF reserves the right to contact, screen, and possibly book very large clients to secure our commissions for events including large public or sporting events and Fortune 1000 client events. We reach out to our contractors for many of these large events.

All communications and calls can be recorded and monitored by ATF for quality of service and accuracy. This is your only notice that all calls can be recorded.

Section 2. Late Payment Charges

Late payments are subject to account temporary suspension and a $20 per month or 5% of the balance per month (whichever is higher) as a late fee, plus collection costs and our hourly labor fee for collecting at $80.00 per hour.

Late payment locks you out of past client leads, your member account, and all data until paid in full.

Section 3. Late Commission Penalties

Over 30 days late in paying a commission results in a fee of 25% of the gross value of the lead you did not pay on for the first month, and 10% additional late fee on the gross value (for each month or partial month) of the lead you booked with the client - unless you notify us and we agree to different terms. Collections fees may be assessed at $80 per hour of our staff time working on collecting, plus any legal fees, attorney fees, and collection agency costs.

Section 4. Closing Your Account

Closing of your account is done only online by logging into your account and choosing the option to terminate your account. Many terms agreed to will continue in force after closing. Closing can also be done in writing to our address, but may take up to 14 days to process.

We may continue to list your account on our pages along with our review of your company while closing your account to all other resources you had as a member. This is to give more information to clients to help them pick the right vendors for their events from our directories.

Section 5. Refunds

Advertising fees are non-refundable. Commissions paid are non-refundable. Some subscriptions are non-refundable. See terms for each Product, Service, or Subscription you sign up for.

Section 6. Account Suspension or Closure

ATF reserves the right to close your account if customers complain to us about the quality of products/services you are offering them, or if you are involved in illegal activities, false information, threats, propaganda, promoting or aiding groups that threaten the security and freedom of others, hateful speech, bullying, harassment, racist communications, or similar - all at our sole, objective review.

We can close your account for any electronic communication that interferes or slows down our web servers, email servers, or communication systems excessively, or for spamming others using any communications system. If we close your account for these issues above, there are no refunds. We can also post publicly communications violating our terms about you, including if you are behind in payments to us.

We can close your account if you stop communicating back with us after we have tried at least 3 times by phone and 3 times by email within 14 days. We will assume that you are out of business and any contracts you have signed with us, we may elect to terminate and assess all expenses to you in order to fulfill those contracts we have with our clients.

Section 7. Service Changes

User understands and agrees that ATF may alter, suspend, or discontinue the Site and/or the Services and may change any information, features, and functions at any time for any reason, without notice, cost, or liability.

From time to time the Site and/or the Services may be inaccessible, unavailable, or inoperable for any reason, including: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs; or (iii) causes beyond the control of ATF or which are not reasonably foreseeable by ATF, including interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion, or other failures.

Refunds are not allowed for outages. There may be issues where we lose data. Please make copies of your information stored in our system so you have a backup.

Section 8. Right to Remove or Restrict Access

ATF reserves the right, in its sole discretion and without notice, at any time and for any reason, to: (i) remove or disable access to all or any portion of the Site or the Services; and (ii) suspend or terminate User's access to or use of all or any portion of the Site or the Services.

The Site contains hyperlinks to third-party websites. The linked sites are not under the control of ATF, and ATF is not responsible for, and makes no representations or warranties with respect to, the contents or privacy policies or practices of any linked sites or any link contained in a linked site. The inclusion of a linked site is for User's convenience only and is not intended as an endorsement or recommendation by ATF.

Section 9. Account Removal From ATF

ATF can close your account for failing to honor your contracts with your clients or agreements with ATF and the clients we have, including leads from us.

Section 10. Hold Harmless

You agree to hold harmless and indemnify ATF and its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorney fees.

Section 11. Data Deletion Request

A request to close your account and delete all data follows our general terms found on our home page www.alltimefavorites.com (at the bottom of the page) in regards to member/client deletion requests.

Section 12. Disclaimer of Warranties

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND, TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ATF EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USE OF THE SITE AND THE SERVICES IS AT USER'S SOLE RISK.

ATF does not represent or warrant, and disclaims any and all responsibility for any loss, injury, claim, liability, penalty, or damage of any kind whatsoever resulting from, arising out of, or in any way related to: (i) any errors in or omissions from the Site and its content, including technical inaccuracies or typographical errors; (ii) the unavailability or uninterrupted use of the Site or the Services; (iii) defects, viruses, or other harmful components on the Site or the server; (iv) any third-party websites or content therein directly or indirectly accessed through hyperlinks; (v) User's use of the Site or the Services or any relationship between User and a linked site; (vi) User's use of any equipment or software in connection with the Site; and (vii) including but not limited to loss of business to any advertiser, ATF does not make any representation or warranty as to any results that may be obtained by use of the Site or the Services.

Section 13. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL A "COVERED PARTY" BE LIABLE TO USER OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, RELIANCE, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, including without limitation economic loss, penalties, or attorneys' fees, for any matter arising from or relating to the Site, including its content, the Services, or the Internet generally.

Some states prohibit the exclusion or limitation of incidental or consequential damages, thus this limitation of liability may not apply to User. If User is dissatisfied with the Site, User's sole and exclusive remedy shall be for User to discontinue use of the Site.

A "Covered Party" means ATF, its affiliates, and any officer, director, shareholder, partner, employee, subcontractor, representative, agent, successor, or assign of ATF or its affiliates.

To the extent permitted by law, the total liability of ATF, and its suppliers and distributors, for any claim under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).

Section 14. Applicable Law

These Terms shall be governed by the laws of the State of Minnesota, as they apply to agreements made and solely performed therein, without regard for conflicts of law. All actions, claims, or disputes arising hereunder or relating to the Site shall be exclusively subject to the jurisdiction of the federal and state courts in the County of Dakota, State of Minnesota.

Section 15. Severability

In the event any provision of this Agreement is held to be unenforceable, such provision will be reformed only to the extent necessary to make it enforceable, and the other provisions of this Agreement will remain in full force and effect.

Section 16. Customer and ATF Reviews

We have the right to post your company and our reviews along with customer reviews of service received from your company - along with email or voicemail communications with you - to the public Internet even when you are active or not with our company. This is to show visitors using our site what people thought of your company. We can include any communications we have from You to ATF in these reviews.

Section 17. Trademarks and Copyright

You agree that the materials you make available to ATF to advertise and market you are legally yours, and you allow us to use them as described in this agreement. You agree to abide by all applicable laws regarding copyright, trademark, patents, and similar, and to hold ATF harmless for materials you provide that violate any of those areas of law. If we are served with legal papers to remove materials that you may not have rights to use, then we will try to quickly comply with those requests.

Section 18. User Experience on Your Website

We want customers to have a great experience when visiting your website. You agree not to display ads that do not comply with Better Ads Standards. We will not link to your site if we find too many broken links, generally known spammy techniques on pages, or too many technical errors. We will try to have our automated system notify you of issues we find.

Section 19. Covid-19 Terms

In order to help stop the spread of the Covid-19 virus and mutations, many large corporate clients require proof of vaccination prior to meeting with and/or delivering any products or services during an uptick in cases or outbreak, epidemic, or pandemic.

If a client requires staff to be vaccinated to work on a client request and you wish to not comply with that prior to contracting and accepting the job, we have no issue with that.

If you agree to do a job and it requires staff to be vaccinated and you fail to provide that, you can be terminated from that job, from our supplier-member system, and be responsible for damages incurred to replace your company on that job for the client.

Section 20. Communications With Us

We have the right to post any communications between our companies or publicly posted content online about you or your company during and after your membership ends here - for the purpose of educating others how you treat other people, our company, your clients, and whether you agree to our code of conduct. For example: if you threaten us, treat us badly, or engage in illegal or unethical activities, we may post this information about you on our websites for clients to see, forever.

Legal Binding Agreement

Legal questions? Please seek an attorney. This is a legal, binding agreement and you are agreeing that you have the authority to enter into this agreement for yourself or the company you represent.
