Legal Terms of Agreement - Terms of Service
This is a legal agreement between All Time Favorites Inc. (ATF, We, Our)
and Supplier/Merchant/Member/Vendor/Client (You, Your)
These terms are related to products and services such as advertising in our directories, being contracted by All Time Favorites, and receiving customer leads from All Time Favorites Inc from our websites and communications systems. “You, Your” also includes informing your staff, employees and those under your direction about these terms.
To make sure you do not miss any emails from us, make sure you add us to your contact list and “safe list” so that emails from any address at alltimefavorites.com come to your inbox and do not get filtered to junk/spam/updates. Talk to your email provider on how to filter all email from us to your inbox or Google online “how to add an email filter for important email” or Google “How to add an important email to only go to my inbox”.

General Conditions
These Terms and Conditions of Use (the "Terms") apply to your advertising on, access and use of www.alltimefavorites.com ("ATF","Site","we", "us", "our"). You (“Member”, "User", "you", "your", "advertiser", “member”, “vendor”) agree to be bound by these terms in full by signing up and participating in our products, subscriptions and services. We offer products and services to You as “Products” or “Subscriptions” or “Services” listed in this contract. If these terms are not acceptable, then do not submit your information to our Site or use our Site(s).
IMPORTANT! Code Of Conduct:
Good moral character, ethics, honesty, and high integrity are very important to All Time Favorites.
To be a part of All Time Favorites, members/vendors (you) agree to operate your business in an ethical, law-abiding, respectful and honest way. Our goal includes respecting all people regardless of race, religion, nationality, sexual orientation, gender, or age.

This comes from our 30+ years experience, Over 50,000 vendors/members and over 450,000 clients.
Many of our large clients require a detailed Code of Ethics or Conduct signed by our members to work on the large corporate and public events to help protect their image and brand (and ours).
Your account can be suspended or closed (without refund), if you, your staff, or subcontractors are knowingly doing business, with companies, people, or organizations, (where it is widely known or you are aware of) who have engaged in the following:
Illegal activities (including but not limited to): being convicted of verbal, physical or sexual attacks on others;
Distribution/promotion of: conspiracy theories, disinformation, proven false information or fake news;
Bullies, cheats or disrespects others;
Promotes known lies;
Promotes white supremacism, racism, anti-semitism, homophobia, or any type of hate speech;
Promotes the war against Ukraine;
We have found that those who support others involved in bad/negative/hurtful/hateful activities as listed above, tend to be like those they associate with through any communication form, selling products/services to, or even “liking” through online social media posts.

Our clients cannot have their reputation (or ours) damaged by our vendors/members who associate and admire these bad companies and people.
Vendors/Members who help bad companies or associate with bad companies/people like that are propagating and assisting those companies and people to grow and reach even more people to continue their bad character traits, hurtful speech and immoral and unethical activities.
We monitor social media posts and other communication, to assure our Code Of Conduct is adhered to.

We screen vendors applying to be a member here. We read online social media posts, reviews on other websites and use other ways to try to filter out low quality vendors and those who do not fit our code of conduct and business model. It is completely up to our sole discretion to allow a vendor to register with us and is also up to our discretion to close any account that does not meet our standards. Our goal is for customers to be confident in what they are getting with our vendors/members and for you to have a great experience should you work alongside other vendors/members of All Time Favorites.
Legal Note on Call Routing/Forwarding/Recording:
We do track calls, emails and texts to your company, some calls are recorded (without further notice) to help track referrals to you. This does require you to promptly login to your account to read and listen to communications from clients or you can lose your listings or subscription with us as customers demand prompt and professional response. We may put up our call routing or referral phone numbers and extensions in place of your phone number in order to track referrals to you and the quality of service provided by you. You agree to allow automated calling systems and text communications to alert you of client communications, missed or late responding to client communications to you, and account-related important messages. You agree to alert your staff receiving any calls on phone numbers from ATF that these may be recorded without any further notice. You agree to abide by all local, state and federal call recording laws and regulations. This is all for the purpose of connecting clients to you quickly and giving both you and the client great customer service and fast connections.
Basic Plan: Website Listings and Leads
Basic Listing - Within your Trial Time-Frame (limited # of leads to respond to and time-frame)
NO up-front monthly cost for your business listings.
Profile page on our website telling about your company listed your product/service categories/cities across our
websites.
Profile pages and listings are limited to space available and under 50 listings in general.
10% commission is due on all sales from us within 30 days after the event date or when your client received your
products/services.
You pick the products, services and cities that you serve and we will list those on our websites.
We refer clients to you in many ways from email, phone, to your online profile on our websites, email message or text messages.
Free call routing of calls using our phone numbers or extensions to your phone number to help document value from us.
We can remove a phone # on your profile if too many calls come through and then we just give them an email form to message
you through our system. Our system notifies you of a new message.
Make sure you allow any emails from our domain alltimefavorites.com to get to your inbox.
Members who pay us through a regular advertising plan may receive leads QUICKER than those in this plan.
Basic Listing - AFTER your Trial Time-Frame is over -
The system will tell you when your trial is over and then the following takes place:
Most times 30-90 days after your trial listing begins but can also be after 10 leads received as we know by that point you can see the value we offer and switch to a paid listing plan.
10% commission is still due on all clients referred to you that result in a current or future sale while on the trial plan before
becoming a paid plan member.
If you choose NOT to pay anything additional per month and stay on the Basic Listing,
We may remove a phone # from your profile and just have clients email message using our system to you.
We may also not display listings unless we have space available.
Not many leads may come your way after your trial time-frame is over.
Commission Questions?
A 10% commission is required back to All Time Favorites within 30 days after an event is completed or delivery of products/services to your client BASED on gross sales price of clients referred to you from All Time Favorites.
Example: A $500 rental agreement equals 10% or $50.00 commission back to All Time Favorites.
Please track leads from us closely as there are strong penalties for failing to pay timely commissions.

The Basic Plan is subject to termination at any time if we see vendors abusing the trial part of this plan. There is a general limit to the # of categories and cities you can have during your free trial and if you pick too many, the system will automatically display less listings based on your website content. Each listing is counted as one product/service category along with a city.
Leads and clients received from this plan PRIOR to switching to a paid “Standard Advertising Plan” WILL STILL BE SUBJECT to a commission (above). New leads received after switching to a paid plan without commission, will be marked as such. PRIOR leads are commission-due.
All communications and calls can be recorded and monitored by ATF for quality of service and accuracy.
It is suggested to switch to a paid plan below if you want to keep getting leads regularly after your Basic Listing trial period.

Standard Advertising Plans: Website Listings and Leads
We offer a lot of benefits for paid subscriptions:
Higher listings on our web pages.
Priority over Basic Plan Vendors (non-paying) when working under All Time Favorites on large events.
Faster Referral of leads to you and if enough paying vendors respond, the basic listing vendors do not get the lead.
More traffic to your company profile (on our servers) than Basic Listing Vendors.

Rates are based on the categories and cities you pick in your member account.
A. Minimum Standard Rate Plan:
Pay a minimum monthly fee + 10% commission (on the gross sale price) to keep listings and get leads.
Prices are displayed in your member account.
If you pay less than the minimum required our computer will auto-pick the categories you are in for
listings and leads (based on your website mostly).
B. Premium Plan: (see rates listed in your member account)
Continue to get leads and listings for the categories you have on file.
Link to your website directly from your profile page on our website.
OPTIONAL 10% Commission on sales from referrals from All Time Favorites except for a single client during a calendar month ordering over 2500 or spending over 2500 during that month, then 10% is due on the amount OVER 2500 dollars (not the amount under 2500). Please track LARGE CLIENT referrals closely.
Why should you pay OPTIONAL commissions?
It gives you bonus points in your account for higher listings in our directories and many other benefits.

Position on our web pages is based on many factors including speed of response to clients, quality of products and services, feedback from clients and your peers, reviews, amount paid per month and commissions paid accurately and on-time. You can get top position in a category and/or city based on what you pay. Minimum rates apply for certain categories. The rates display after you login to your member account and choose products & services and a leads plan.
Commission amounts can be changed on a per client (nonprofit event or special circumstance) but need to be approved by All Time Favorites or the regular % commission will still be required.
Commissions plans require commission for a client no matter how many events or years as long as you have a member account with All Time Favorites. Termination of a commission plan or commission category requires commissions paid for 3 more years from termination approval date from All Time Favorites.
RATE CHANGES: If rates change higher and you do not agree to the new rates or do not respond before the new rates take effect, your current monthly rate will stay the same, however, our computer or our staff can reduce the display of listings and number of leads to match the rate you pay. Rate increases are relayed via email. If your email goes into your spam box, we are not responsible for that.
Please make sure our email is going to your important or inbox. Contact your email provider to help you make sure our emails do not go to spam. Safelist any email from @alltimefavorites.com with your email provider
For some product categories or vendors-members(you), we may assign a different phone # and extension to help track phone leads to your company and for tracking commissions. All communications and calls can be recorded and monitored by ATF for quality of service and accuracy. (tell your staff also). This is your only notice that all calls can be recorded.
IMPORTANT: CHANGING your advertising spending per category and REFUNDS:
If you remove categories and listings in your account, there are no refunds for that month.
If you add more listings, pay close attention to the rates the system shows you and pick your level of advertising benefits to match your needs. For example: If you add 100 listings and do not change how much you pay, the system may drop you into a commission required level or limit listings if you pay less than a minimum listed (see above for plans and options)
When we calculate partial monthly advertising using the nearest penny, rounded up.
Advertising charges start on the 1st of the month and 1 calendar month is from day 1 to the last day of the month. If you start advertising later than the 1st of the month, the amount is pro-rated the first month and then goes to the regular amount on the 1st of the next month following.
The start day for billing a prorated month, is calculated based on the date in the Central Time Zone.
2. REFUNDS: If you cancel advertising or reduce listings, there are no refunds within that month for paid advertising levels.
If your account is suspended due to lack of response to customers, messages from clients, leads sent to you there are NO refunds if we stop sending leads/customers/phone calls/direct messages from clients, due to no response (your listing may still be up on our websites). We are NOT responsible for your email or text system sending our communications to your spam box. Seek your IT or Tech department to always filter our communications from going to junk boxes.
Nonprofits Plan: Website Listings and Leads
For registered 501c3 and similar nonprofits only
No monthly fee for basic listings in this Plan. Nonprofits only.
Leads and Listings if space is available on our websites.. Commission to us on sales is OPTIONAL, but appreciated. We do require you to put us on your referral list (if you have one). A referral list is a list of vendors you suggest to your Clients for additional products and services.
Usage fees apply if volume of leads and traffic increases beyond a certain level. You will be alerted if usage is high, after all, you are paying zero for this listing so we have to watch closely the volume.
Know that ALL communications and calls can be recorded and monitored by ATF for quality of service and accuracy and please notify all your customer service staff too. Promotional credits are added to your account for use in listings and leads on our website based on the agreement we have between ATF and members. Contact us after you sign up for this plan. Your organization can spend additional advertising funds if you want to have a higher rank on our website than the promotional credits apply towards. There is no monthly maintenance account fee at this time. The number of items listed (category+city) may change in the future but is FREE for under 100 categories (items) at this time.
Custom Plan: Custom Advertising Plan - Designed just for your needs.
We can do a custom plan from % of revenue share, Pay-Per-Click, and many other options to list you on the top of our pages, exclusive listings and more. Call 800-232-6874 ext 388 for Brian for a custom package. We can make almost any package work for you.
Subcontractor Plan: Sub-contracted only: No website links or profile listing on our website with your company information.
No cost to be on this plan at this time. Over half of the business we send to vendors is through listings on our website like “Basic Plan” or “Standard Advertising Plan” (not this plan) so under this plan we just use the materials from the Internet, your website and/or what you send us and create materials without your name and contact information on it as you wish to be subcontracted only. We may use these materials, edit them and use them in our marketing and advertising and on our websites in perpetuity. The goal is to attract customers with these materials and get you work! ATF will send you leads to quote and you will quote directly pricing back to ATF for jobs. This plan is best when you want us to screen the clients and contract or direct refer to your sales department specific leads. ATF will then pitch to the client, add our margin to the price, and contract you on the job if the client likes everything. We can show your products and services online (branding removed) and edit/create marketing and media materials to get clients. This editing of your materials is perpetual use allowed (even if you are no longer a member). There is no monthly account fee like in the other plans on this system.
All Plans:
Keep in mind that we do screen leads for large corporate clients and we have been in the events business for over 30 years. Some clients and larger client events, we may become the primary event production company for that lead. We also have many years with a large client base prior to our Internet Leads System so some clients remain ours. We do reach first to the members on our system here to subcontract and network with as needed to make customers happy. We regularly hire and subcontract our members on large events. We do not guarantee that every lead received is available directly to connect you to the client, some of these you will be subcontracted under All Time Favorites or one of our networked production companies and planners. This is a very good thing as we win many of these competitions for event production over other companies and then subcontract our vendors on those events. These are complex events with many moving parts from logistics, insurance, OSHA, security clearances, background checks, technical production, celebrity act negotiation and more. Some terms can have “Special Terms” agreed by ATF and member/vendor and those display upon login within your member account under leads and marketing plans.
Under any advertising and marketing plan, we can use images, media, audio, videos, links, other similar media, promotional advertising materials that you have given us access to online or delivered electronically or via mail to ATF. We can create materials from and edit these for our websites and for marketing your products and services in any forum with or without your contact information on them in perpetuity.
AI NOTICE: We may use AI to edit and generate content from your materials (listed above) for promotional content on our websites and to promote your products and services. We do not break down your voice or original songs and create new content from the voice or original music without your explicit permission.
For all paid advertising plans, there is a minimum cost of $10.00 per month required.
If you are on a plan requiring a commission or within a product/service category requiring a commission. The current commission rate on sales is 10% back to All Time Favorites computed on the gross price within your agreement with the client (minus any airline fees, hotel fees or transportation/shipping costs). You can contact ATF about a specific client and negotiate outside that amount but ATF and Vendor need to both agree on a variance of the commission amount for that purchase or event.
Points and Promotional Credits Earning Plan -- EARN POINTS and Promotional Credits.
We appreciate your help in promoting our websites and your participation.
You can earn reward points and/or promotional credits for simply linking to our website pages, writing articles about us online, referring clients to us, responding to leads quickly and other ways. These points may include promotional credits that you can apply to qualifying products and services offered here. These points may also be used to pay for advertising or other products and services through All Time Favorites (some promotional credits expire after time and some available only for specific products and services). These can apply to your monthly account maintenance fee for paid advertising accounts or used on any product or service we offer. More details soon…
ALL PLANS - Most everyone approved to list with us gets a basic company listing and some leads to start. Amount of leads varies based on traffic to your company from ours. The computer will alert you that your free listing may be out of leads and to continue to get leads you may want to upgrade your listing plan. You don’t have to pay for advertising and will probably still be listed with us in our directories and get a few leads here and there. A commission back to us still applies on all sales made from our leads, listings and referrals to your company.
For all plans, (unless otherwise agreed upon between both ATF and you), we can put up a tracking phone number and record calls to you for quality of service to client leads we have and to help prevent fraud or not paying commissions.
Some advertising categories that you list in such as large mobile stage rentals, large event production, PPE categories for commercial clients will be restricted to ATF screening clients first and/or subcontracting you on those jobs. The nice thing is that you get the work either way on this system directly from clients or directly from ATF.
Lack of response to leads, client phone calls, or voicemails to your company through All Time Favorites in your account may result in removal of your contact information next to your listings and only a contact form or tracking phone# instead of a link to your profile page until you start responding to leads again. We are not responsible for email delivery issues. You can easily list multiple email addresses to receive leads at if you like in your account.
Lack of quick response to direct communications from clients requesting quotes to your company may result in us closing the lead to you and sending the lead to vendors who do respond.
Lack of response to leads or communications to us or to client leads given to you may result in leads not being sent to you, or your listings and account suspended. There are no refunds for your lack of response to leads or lack of response to clients or ATF trying to communicate with you and no response back within 7-14 days.
Lack of prompt response to customers may lead to suspending your leads and listing account temporarily until you respond back again. There are NO REFUNDS during a suspension.
All vendors give All Time Favorites permission to text you at the numbers you give us to contact you and we may call using automated calling equipment. This is mainly used when you are late on a customer waiting for a quote but can be for other important account notifications.
Low sales rates to the leads we send you: Example: If we send you 100 leads and you fail to sell anything to them or very little to them, we may suspend or downgrade your account (not send leads) We will try to help you in how to sell when we can, and we have a lot of sales materials online to assist you.
If you are on a plan with us where commissions are required then commissions are valid for the life of a client as long as you are a part of All Time Favorites as an active member. If you end your advertising or membership with All Time Favorites, commissions from leads you have accepted and clients we have referred to you, will end 3 years later after you ended your membership or on the 1st day of the next month (whichever is later).
Additional charges may apply for listing or uploading many photos, videos, PDF files and other media files on our servers, but you can review and approve those prior to being charged.
We may remove product/service categories from your listings if we find that you respond to clients with “do not have that product or service” or “out of area” too often (at our discretion) and we may remove listings in your account that we do not find that you have on your website or marketing materials. We may edit your listings with us to fix grammatical errors and non-substantiated sales pitches or similar.
We may remove listings where you regularly say you do not have that product or not in that specific area or city.
All communications and calls can be recorded and monitored by ATF for quality of service and accuracy. Please tell all your staff about this as this is the only notice you might receive to this effect.
We are not responsible for leads, voicemails, texts or other communications from clients trying to reach you from our system and that communication does not reach you such as email going to your junk email box. Please regularly check into your account for missed communications and make sure your computer person has set up your system not to miss important notifications from us and potential clients trying to reach you. We are not responsible for business loss due to leads or potential client communications not making it from our system to yours. We do have staff on 24 hours a day to keep our systems running and are very serious about the business of connecting clients to you and offering services to help your business run easier.
Additional General Terms:
1. FOR ALL Advertising Accounts and Plans
ALL ACCOUNTS may trigger a usage fee at some point if the volume of traffic, emails and leads to you exceeds regular usage levels. You can approve any new fees prior to their charging.
ATF reserves the right to contact, screen and possibly book very large clients to secure our commissions for events not limited to large public or sporting events, and fortune 1000 client events or similar. We reach out to our contractors for many of these large events. We also have been producing events over 35 years so some clients may be exclusive to us.
Calls are recorded between us and referrals to you for quality of service, accuracy and getting our commissions (to name a short list of reasons for recording calls).
CALL RECORDING LEGAL NOTICE: Some states require both parties on the call to know the calls are recorded. You agree that this is be your ONLY notice and you agree we can record calls referred to you and all calls to and from your company, staff and subcontractors of yours. You agree to let your staff and contractors know that calls are recorded with All Time Favorites.
We allow the clients through this ATF system and websites to contract directly with ATF to provide products and services for their event. This is our premium, full-service event management, emergency disaster recovery, last-minute urgent service, or full-service event production services. We try to use our ATF members on all these events. We very much like to network with our other event producers and production companies on large-scale events. We have over 25 years experience and with our partners at ATF, have worked on the production of events over two million dollars for a single event.
We can delay client leads to vendors if we feel a client needs vetting or verification first or due to client fraud.
We can also assist a client in matching up to a quality vendor if the client wants that help. Lead to you may be delayed or not allowed due to client screening and the quality of your response to ATF for that lead.
We BLOCK communication and access to our directories and lead systems from some computer systems, networks and clients that have been shown to be from robots, skimmers to our content and false clients in other countries.
We can ban any client or company from using our lead system for any reason (mostly due to time-wasters, no budget client requests, false information and similar)
Some additional organizations are banned from using our website (names not disclosed) but those who abuse our system for quotes, those that violate human rights under the name of religion, and cult-like operating organizations.
You will not get every communication via phone, email or text due to some clients or activities from clients will result in banning those communications from getting to you due to fraud or other reasons. There is no loss-of-business or damage to your business claim allowed against ATF for our discretion is final in this decision to relay or not relay a client lead or communication to you.
We ban clients who have ripped off vendors in the past or have failed to pay vendors as promised.
We do not guarantee access to this system 24 hours a day as we are not responsible for access to leads or products/services due to maintenance or any downtime caused by us or outside forces beyond our control - no refunds for outages.
If you switch options from commission to paid advertising, the leads received prior to that point are commission required.
NOTE: This entire system is “usage-based” for leads, directory listings and other products and services (as outlined) with many that have “free or commission trial levels” until you reach the higher volume or usage. If you get a lot of traffic from us, lots of leads, emails, communications, you may get a notice of additional fees based on usage. You will be able to approve these or reduce your listings instead. During any plan, we can also remove you from high-traffic basic listing categories due to lack of response to leads or low sales or closing rate with leads we send you.
2. Late Payment Charges. Late payments are subject to account temporary suspension and a $20 per month or 5% of the balance per month (whichever is higher) as a late fee + collection costs AND our hourly labor fee working on collecting at $80.00 per hour.
Late payment does LOCK you out of past client leads received, your member account and all data, and direct leads received until paid in full. If you are terminating leads services then you still will have access to your past leads you said YES to and received, unless you have violated other terms of this agreement. We are working on the ability to download all data to take with you soon. We can manually do it for now upon request.
3. Late COMMISSIONS. Over 30 days late in paying a commission results in a fee of 25% of the gross value of the lead you did not pay on for the first month and 10% additional late fee on the gross value (for each month or partial month) of the lead you booked with the client unless you notify us and we agree to different amounts or other terms. Collections fees may be assessed at $80 per hour of our staff time working on collecting PLUS any legal fees, attorney fees and collection agency costs.
4. Closing your account completely: Closing of your account is done ONLY online by logging into your account and choosing the option to terminate your account. Many terms agreed to will continue in force after closing. Closing can also be done in writing to our address but may take up to 14 days to process and is completed when we call or email you back that we have received and processed your account closing. We may continue to list your account on our pages along with our review of your company, while closing your account to all the other resources you had as a member. This is to give more information to clients to help them pick the right vendors for their events from our directories.
5.Refunds: Advertising fees are non-refundable. Commissions paid are non-refundable. Some subscriptions are non-refundable. See terms for each Product, Service or Subscription you sign up for.
6. We can close or suspend your account without refund:
ATF reserves the right to close your account if customers complain to us about the quality of products/services you are offering them, if you are involved in illegal activities, false information given to others, threats to others, propagating or promoting lies and hate speech, promoting or aiding groups or persons that threaten the security and freedom of others, are involved in posting or communicating lies, false accusations, false facts, hateful speech, bullying others, harassment, support of any threatening group or organization of people, or racist communications, all of which is at our sole, objective review. We can close your account for any electronic communication that interferes or slows down our web servers, email servers or communication systems excessively, or for spamming others using any communications system. If we close your account for these issues above, there are no refunds. We can also post publicly communications violating our terms about you, including if you are behind in payments to us. We can close your account for violating our Code of Conduct. We can close your account if you stop communicating back with us after we have tried at least 3 times by phone and 3 times by email within 14 days. We will assume that you are out of business and any contracts you have signed with us, we may elect to terminate and assess all expenses to you in order to fulfill those contracts we have with our clients. We may close your account if officers within your company have been convicted of a crime. We can close your account, subscriptions or event requests at any time due to false litigation against us, claims against us without legal merit, defamation or libel against us and all decisions are at our sole discretion.
7. User understands and agrees that ATF may alter, suspend or discontinue the Site and/or the Services and may change any information, features and functions of the Site and/or the Services at any time for any reason, without notice, cost or liability. User further understands and agrees that from time to time the Site and/or the Services may be inaccessible, unavailable or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which ATF may undertake from time to time; or (iii) causes beyond the control of ATF or which are not reasonably foreseeable by ATF, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures. User acknowledges and agrees that ATF has no control of the availability of the Site or the Services on a continuous or uninterrupted basis and refunds are not allowed. There may be issues where we lose data for whatever reason. Please make copies of your information stored in our system so you have a backup.
8. ATF reserves the right, in its sole discretion and without notice, at any time and for any reason, to: (i) remove or disable access to all or any portion of the Site or the Services; and (ii) suspend or terminate User’s access to or use of all or any portion of the Site or the Services. Links the Site contains hyperlinks to third party web sites. The linked sites are not under the control of ATF, and ATF is not responsible for, and makes no representations or warranties with respect to, the contents or privacy policies or practices of any linked sites or any link contained in a linked site. The inclusion of a linked site is for User’s convenience only and is not intended as and should not be construed as an endorsement or recommendation by ATF of the linked site or its content.
9. We can remove your account from ATF agency and directories:
ATF can close your account failing to honor your contracts with your clients or agreements with ATF and the clients we have including leads from us.
10. Hold Harmless:
You agree to hold harmless and indemnify ATF and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorney fees.
11. Data Deletion Request:
A request to close your account and delete all data follows our general terms found on our home page www.alltimefavorites.com (at the bottom of the page) in regards to member/client deletion requests.
12. Disclaimer of Warranties
THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND, TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ATF EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USE OF THE SITE AND THE SERVICES IS AT USER’S SOLE RISK. 13. Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL A "COVERED PARTY" (AS DEFINED BELOW) BE LIABLE TO USER OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, RELIANCE OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ECONOMIC LOSS, PENALTIES OR ATTORNEYS’ FEES, FOR ANY MATTER ARISING FROM OR RELATING TO THE SITE, INCLUDING ITS CONTENT, THE SERVICES, OR THE INTERNET GENERALLY, INCLUDING, WITHOUT LIMITATION: (i) USER’S USE OR INABILITY TO USE THE SITE OR THE SERVICES; (ii) ANY CHANGES TO OR INACCESSIBILITY OF THE SITE OR THE SERVICES; (iii) DELAY, FAILURE, UNAUTHORIZED ACCESS TO OR ALTERATION OF ANY TRANSMISSION OR DATA; (iv) ANY MATERIAL OR DATA STORED, SENT OR RECEIVED OR NOT STORED, SENT OR RECEIVED; (v) ANY TRANSACTION OR AGREEMENT ENTERED INTO THROUGH THE SITE OR THE SERVICE; OR (vi) ANY DATA OR MATERIAL FROM A THIRD PERSON ACCESSED ON OR THROUGH THE SERVICES; WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT OR OTHERWISE, REGARDLESS OF ANY NEGLIGENCE OF ANY COVERED PARTY. SOME STATES PROHIBIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THUS THIS LIMITATION OF LIABILITY MAY NOT APPLY TO USER. IF USER IS DISSATISFIED WITH THE SITE, USER’S SOLE AND EXCLUSIVE REMEDY SHALL BE FOR USER TO DISCONTINUE USE OF THE SITE. A "COVERED PARTY" MEANS ATF, ITS AFFILIATES, AND ANY OFFICER, DIRECTOR, SHAREHOLDER, PARTNER, EMPLOYEE, SUBCONTRACTOR, REPRESENTATIVE, AGENT, SUCCESSOR OR ASSIGN OF ATF OR ITS AFFILIATES.
WHEN PERMITTED BY LAW, ATF, AND ATF’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ATF, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).
IN ALL CASES, ATF, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE.
14. Applicable Law
These Terms shall be governed by the laws of the State of Minnesota, as they apply to agreements made and solely performed therein, without regard for conflicts of law. All actions, claims or disputes arising hereunder or relating to the Site shall be exclusively subject to the jurisdiction of the federal and state courts in the County of Dakota, State of Minnesota.
15. Sections of this Agreement
In the event any provision of this Agreement is held to be unenforceable, such provision will be reformed only to the extent necessary to make it enforceable, and the other provisions of this Agreement will remain in full force and effect.
16. Customer and ATF Reviews:
We have the right to post your company and our reviews along with customer reviews of service received from your company along with email or voicemail communications with you to the public Internet even when you are active or not with our company. This is to show visitors using our site what people thought of your company. We can include any communications we have from You to ATF in these reviews.
17. Trademarks and Copyright Infringement Lawsuits:
You agree that the materials you make available to ATF to advertise and market you are legally yours, and you to allow us to use as described in this agreement. You agree to abide by all applicable laws regarding copyright, trademark, patents and similar and hold ATF harmless for materials you provide that violate any of those areas of law. If we are served with legal papers to remove materials that you may not have rights to use, then we will try to quickly comply with those requests.
18. User experience on your website: We want customers to have a great experience when visiting your website. You agree not to display ads that do not comply with Better Ads Standards Here. We also will not link to your site if we find too many broken links, generally known spammy techniques on pages and too many technical errors. We will try to have our automated system notify you of issues we find.
19. Covid19 Terms of Agreement:
In order to help stop the spread of the Covid-19 virus and mutations,, many large corporate clients REQUIRE proof of vaccination prior to meeting with and/or delivering any products or services during an uptick in cases or outbreak, epidemic or pandemic.
If a client requires staff to be vaccinated to work on a client request and you wish to not comply with that PRIOR to contracting and accepting the job, we have no issue with that.
If you agree to do a job and it requires staff to be vaccinated and you FAIL to provide that, you can be terminated from that job, from our supplier-member system and be responsible for damages incurred to replace your company on that job for the client.
While we do not mandate you be vaccinated, we will hire more of our members who could be vaccinated and ARE vaccinated over those who refuse to be due to those who do not get vaccinated (and are able to medically, but refuse) are responsible for giving the virus a person to create mutations within and allows the person to carry a higher viral load to those who are vulnerable to the virus and could die. This is the factual science of the virus situation. We want everyone to be responsible and care about others without spreading this virus needlessly.
20. Communications with us. We have the right to post any communications between our companies or publicly posted content online about you or your company during and after your membership ends here in order for (but not limited to) the purpose of educating others how you treat other people/our company/your clients and if you agree to our code of conduct (or not) and communications with us to assist others in knowing more about how you treat other people. For example: If you threaten us, treat us badly or others badly, engage in illegal or unethical activities, we may post this information about you on our websites for clients to see, forever.

Our vendors are our top priority and some clients like to bypass us completely without any tracking of sales.
